Welcome to Alserva Votum GeneTrak. Please read these Terms and Conditions (“Terms”) carefully before using our mobile DNA testing services or accessing our website. By scheduling an appointment, using our services, or visiting our website, you agree to these terms.

1. Service Eligibility

• You must be at least 18 years old to schedule or consent to DNA testing, or have the consent of a parent or legal guardian if under 18.
• You must provide accurate, complete, and current information during scheduling and sampling collection. 

2. Service Description

• Alserva Votum GeneTrak provides mobile DNA sample collection and coordinates laboratory analysis for paternity, relationship, legal, and other DNA tests.
• We partner with accredited laboratories for all DNA tests.
• We do not provide medical diagnosis or genetic counseling.

3. Legal Compliance

• All services comply with applicable federal, state, and local laws, including but not limited to HIPPA (Health Insurance Portability and Accountability Act), and state privacy and consent laws in Indiana, Illinois, and Ohio.
• Legal and immigration testing services adhere to strict chain-of-custody procedures to ensure court or government admissibility.
• You are responsible for ensuring that your use of our services complies with any applicable laws or court orders.

4. Privacy and Data Protection

• All personal and genetic information is handled in accordance with our [Privacy Policy].
• We use secure, encrypted methods for data storage and transmission.
• Results are only released to authorized individuals as specified at the time of consent.

5. Payment, Fees, and Refunds

• Full payment is due at the time of scheduling or sample collection unless otherwise agreed in writing.
• Service prices, mileage fees, additional participant fees, and rush result fees are clearly stated at scheduling.
• Cancellations made more than 24 hours prior to the scheduled appointment will receive a full refund. Cancellations within 24 hours may be subject to a cancellation fee.
• No refunds will be issued after sample collection has occurred.

6. Sample Collection and Results

• You agree to cooperate fully during the sample collection process and to follow all instructions provided by our staff.
• For legal tests, all parties must present valid government-issued photo identification.
• Results are typically available within the stated timeframe but may be delayed due to unforeseen laboratory or logistical issues.
• We do not guarantee specific outcomes or interpretations of DNA tests results.

7. Limitations of Service

• DNA testing can only determine biological relationships to the degree of certainty stated in your results report. 
• Results are not a substitute for legal, medical, or professional advice.
• Alserva Votum GeneTrak is not liable for decisions made based on DNA test results.

8. Limitations of Liability

• To the fullest extent permitted by law, Alserva Votum GeneTrak, its employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of our services.
• Our total liability for any claim arising out of or relating to these Terms or our services is limited to the amount you paid for the relevant service.

9. Dispute Resolution and Governing Law

• These terms are governed by the laws of the State of Indiana, without regard to its conflict of law principles.
• Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in Marion County, Indiana, unless otherwise required by law.
• You agree to waive any right to a jury trial or to participate in a class action.

10. Changes to Terms

• We reserve the right to update or modify these Terms at any time.
• Updated Terms will be posted on our website and are effective as of the date posted.
• Your continued use of our services constitutes acceptance of any changes.
